Policy
It is the intent of Loyola University New Orleans to clarify the definitions of employment classifications so that employees understand their employment status and benefit eligibility. These classifications do not guarantee employment for any specified period of time.
Procedure
Each employee will belong to one employment category:
FACULTY employees are employed on a contract basis by the Division of Academic Affairs.
REGULAR FULL-TIME: staff employees who are not in a temporary status and generally are regularly scheduled to work Loyola University’s full-time schedule of at least 37.5 hours per week. They are eligible for Loyola University’s benefit package, subject to the terms, conditions, and limitations of each benefit program. Some hourly staff are regular full-time employees whose duties may involve shift work and who are normally scheduled to work 40 hours per week.
LIMITED TERM APPOINTMENTS: staff members who are employed with the University for a pre-determined length of time, normally not less than one full year, who may be eligible to receive benefits in the same manner as full-time regular employees. Limited term employees are generally paid via grants or other special funding.
REGULAR PART-TIME: staff who are not assigned to a temporary status and who are regularly scheduled to work in one of the capacities described below.
Part-time A staff are regularly scheduled to work at least 30 hours per week. Part-time employees who work at least 30 hours per week are eligible for certain benefits subject to the terms, conditions, and limitations of each benefit program.
Part-time B staff are regularly scheduled to work less than 30 hours per week. While they do receive all legally mandated benefits (such as social security and workers’ compensation insurance), they are ineligible for all of Loyola University’s other benefit programs. Those employees who have worked one-year of service in at least a part-time capacity with a minimum of 1,000 hours during the previous 12 months may be eligible for the University’s retirement plan benefit, subject to the terms, conditions, and limitations of the plan.
TEMPORARY (Full or Part-time) staff are hired as interim replacements to temporarily supplement the work force or to assist in the completion of a specific project. Employment assignments in this category are of a limited duration, generally not to exceed 6 months. Employment beyond any initially stated period does not in any way imply a change in employment status. Temporary employees retain that status unless and until notified of an approved change. Temporary employees receive only legally mandated benefits, (such as workers’ compensation insurance and social security), and they are ineligible for all of Loyola University’s other benefit programs.
TEMPORARY AGENCY WORKERS are individuals who perform work for the University but are on the payroll of a temporary help or outsource agency. Temporary agency workers are not employees of the University.
STUDENT EMPLOYEES are currently enrolled students who also perform work for the University, either under the Federal College Work Study Program or as a Student Assistant or Student Intern. In their role as employees, student employees are subject to the requirements of this manual as well as any specific requirements imposed by their financial scholarship. Students currently enrolled at Loyola or another university will be classified as student employees only if they occupy a student position. If they occupy an approved position normally held by a regular employee, they will be classified as a full or part-time regular employee.
Independent Contractor Status
Determining the appropriate classification of a worker as either an employee or independent contractor is the responsibility of the Department of Human Resources. The Department of Human Resources is guided by Section 3401 of the Internal Revenue Code. Every individual employed by Loyola will be categorized as an “employee” unless specifically designated as an independent contractor by the Human Resources Director.
