Copyrighted Material Policy

Loyola University Central Reproduction seeks your assistance in our efforts to facilitate and enhance the education process within the boundaries of copyright law.

According to Loyola University’s Intellectual Property Rights Policy, Central Reproduction shall duplicate copyrighted materials only in strict compliance with provisions of the U.S. Copyright Laws. Generally, but not always, this will require copyrighted material to be accompanied by written permission to copy.

Instructors may be asked to sign and submit a Copyright Indemnity Agreement (Adobe PDF), certifying that the materials to be copied do not infringe upon copyright law.

Course Packs

Central Reproduction will duplicate course packs to be sold to students ONLY with materials that do not require copyright clearance and/or royalties. Specifically, this means we can only accept course packs under one of the following conditions:

(A) the instructor is the copyright holder

(B) the materials are in the public domain (works whose copyrights have lapsed, works created by the U.S. federal government, judicial opinions or statutes, etc.)

(C) written permissions to copy have already been obtained (see Permission to Copy)

All other course packs should be submitted to the Loyola Bookstore. (See Resources for Instructors.)

Classroom Handouts

Central Reproduction will duplicate copyrighted material for classroom handouts ONLY under one of the following conditions:

(A) the instructor is the copyright holder

(B) the materials are in the public domain (works whose copyrights have lapsed, works created by the U.S. federal government, judicial opinions or statutes, etc.)

(C) written permissions to copy have already been obtained (see Permission to Copy)

(D) the materials fall within the "Fair Use Guidelines" as defined in the "Fair Use" Verification section (page 2) of the Copyright Indemnity Agreement. Instructors must sign and submit this form, certifying that the requested copy work falls within the limits of the Guidelines for Classroom Copying In Not-For-Profit Educational Institutions.

Permission to Copy

Permission to duplicate copyrighted materials may be obtained either directly from the copyright holder or through the Copyright Clearance Center.

Regardless of application (course packs, classroom handouts, or other), permission to copy – whether obtained from the copyright holder or through the CCC – must indicate exact specifications of the material to be used (title, author/editor, edition, page numbers, chapters, etc.) and the number of copies allowed to be made. Also, please specify the course and instructor for which the material will be used.
